Terms of Service

By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have obtained parental or guardian consent to use the App.

To access certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You agree not to use the App to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Upload or transmit viruses, malware, or other malicious code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Harass, abuse, or harm another person
• Send spam or unsolicited communications
• Interfere with or disrupt the App or servers connected to the App
• Use the App for any illegal or unauthorized purpose

You retain ownership of any content you create or upload to the App ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your User Content solely for the purpose of providing and improving our services.

You are solely responsible for your User Content and represent that you have all rights necessary to grant us this license. We do not endorse any User Content and are not responsible for any User Content posted by users.

The App and its original content (excluding User Content), features, and functionality are owned by ARRESTED RELATIONS LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The WinMind name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ARRESTED RELATIONS LLC. You may not use such marks without our prior written permission.

The App may contain links to or integrate with third-party websites, services, or applications. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, secure, or error-free. The conflict resolution guidance provided by the App is for informational purposes only and should not be considered professional advice.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARRESTED RELATIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers or your personal information
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or other harmful code transmitted through the App
• Any errors or omissions in any content

You agree to defend, indemnify, and hold harmless ARRESTED RELATIONS LLC and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the App, violation of these Terms, or violation of any rights of a third party.

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

You may terminate your account at any time by using the account deletion feature in the App or by contacting us at support@winmind.app.

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Wyoming.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the App after any changes constitutes acceptance of the new Terms.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
